What is a California Employment Counseling Service Bond?
Every employment counseling service must submit this bond to the California Secretary of State before providing the following services:
- Career counseling
- Vocational guidance
- Aptitude testing
- Career management
This bond will ensure that the employment counseling service will pay all sums due to any individual or group of individuals when the bonded employment counseling service has received those monies.
This bond will also ensure the compliance of the employment counseling service to Section 1812.510 of the California Civil Code.
How does a California Employment Counseling Service Bond work?
There are three parties to this bond, namely:
Principal – Employment counseling service
Obligee – People of the State of California
Surety – Surety bond provider
When the Principal enters the agreement, he or she is responsible for fulfilling the obligations set forth in the agreement. The Surety will partner with the Principal by extending its credit and by guaranteeing the performance of the Principal.
If the Principal commits a violation, the person (Obligee) who has been harmed by the said violation will be eligible to recover the amount lost by filing a claim against the bond. The Principal must settle the claim or disputes. If the Principal cannot settle it, the Surety will do it on behalf of the Principal.
The Surety will first conduct a thorough investigation of the claim, guarding both the right of the Principal and the Obligee in the process. If the claim is valid, the Surety will pay the Obligee up to the maximum amount of the bond. Under the bond agreement, the Principal must repay the Obligee once the claim has been settled.
